Pescadore Privacy Policy and Personal Data Protection

In compliance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 – GDPR) and other applicable legislation regarding personal data protection, Pescadore adopts the following guidelines for the collection and processing of personal data.

3. Purpose of Collected Data

The data collected on this website is intended for:

  • Contacting the user to respond to submitted requests.

  • Sending, upon user request, service proposals and/or other information about Pescadore’s own services and/or products.

  • Future contacts, namely sending service communications and commercial campaigns from Pescadore.

  • Fulfillment of legal obligations.

The data is thus collected for the purposes indicated above, so every data subject must verify its accuracy and update it so that Pescadore can take appropriate measures for its processing.

The completion of the forms on this website is accompanied by an explicit request for consent from the user for the submission and processing of data as described above. This consent given upon submission of any personal information will translate into prior and express consent to the processing of personal data transmitted by its owner for one or more of the purposes described above, and the Pescadore is authorized to process the personal data collected to the extent and for the time necessary to pursue its purposes.

In compliance with current legal legislation and its policy, Pescadore clarifies that it does not request or encourage, in any location or manner, the submission and sending of personal data referring to philosophical or political convictions, party or trade union affiliation, religious faith, private life, racial or ethnic origin, as well as the processing of data related to sexual life.

Accordingly, Pescadore reserves the right not to accept, collect, or receive information that compromises fundamental rights or appears unlawful, excluding any responsibility for its processing.

Considering the purpose of processing the collected information, Pescadore reserves the right to cancel or annul any request if not all necessary data for the management of the process in question is collected, excluding any responsibility.

4. Retention of Personal Data

Accordingly, it is informed that personal data collected within the scope of any process to be handled by Pescadore may be retained for the period necessary to fulfill the purpose, and may be kept in reserve for future processes or preserved for the continuation of sending promotions or disclosures of actions, services, or products, without prejudice to the data subject’s right to request the deletion of their data (right to be forgotten) at any time, as indicated in the next point.

5. Rights of the Personal Data Subject

The period for which personal data is stored and retained will vary in accordance with the purposes chosen by the data subjects, but always for a period equal to or less than the period stipulated by law, however:

The personal data subject may, at any time, request:

  • Access/request all information held by Pescadore about them.

  • Deletion of all information held by Pescadore about them whenever one of the following reasons applies: (i) the data is no longer necessary for the purpose for which it was collected or processed; (ii) the data subject withdraws consent, when consent is the legal basis; (iii) the data subject objects to the processing and there are no overriding legitimate grounds that justify its retention; or (iv) the personal data must be erased for compliance with a legal obligation.

     
  • Rectification of the information held by Pescadore about them.

  • Portability, restriction, and/or opposition to processing: the data subject must communicate their request in writing to Pescadore, identifying themselves by full name and sufficient identification elements to allow us to adequately identify them and subsequently process their request.

All requests must be made using the addresses and methods identified in point 1 of this privacy policy.

Additionally, the data subject may always lodge any necessary complaints with the competent authority for this purpose (in Portugal, the National Data Protection Commission – CNPD).

6. Security in the Processing of Personal Data

The collected data is processed and stored electronically and on physical (paper) support when necessary.

Pescadore has implemented appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, and against any other form of unlawful processing. Only employees and subcontractors authorized by Pescadore have access to personal data, being bound by the duty of secrecy and confidentiality.

If, for any reason, a security breach occurs that causes, accidentally or unlawfully, the destruction, loss, alteration, unauthorized disclosure of, or access to personal data, Pescadore undertakes, in accordance with applicable legislation, to communicate with the competent authorities without undue delay and, whenever possible, within 72 hours after becoming aware of such occurrence.

As referred, Pescadore undertakes to communicate the personal data breach to the respective data subject, in accordance with applicable legislation.

Without prejudice to the provisions of the preceding paragraphs, the user must adopt additional necessary and enforceable security measures, namely having an active firewall, updated antivirus and anti-spyware, and should exercise caution when accessing third-party platforms, verifying and confirming the existence of a digital certificate and the reliability of the address, excluding any responsibility of Pescadore for facts not attributable to it or non-compliance with specified or enforceable precautionary rules.

7. Communication of Personal Data to Third Parties

The information and personal data to which Pescadore has access will under no circumstances be sold or transferred to third parties.

Within the scope of its activity, Pescadore may resort to subcontractors for the provision of certain services (e.g., payment processors, shipping services, e-commerce platforms, etc.), which may, in some situations, imply access by such entities to the personal data of users or customers.

Should this occur, the data subject consents to this sharing, with Pescadore committing to implement the necessary and appropriate measures to ensure that entities that have access to such personal data are reputable and offer high guarantees in this regard, which will be duly enshrined and safeguarded in a written contract concluded between Pescadore and the subcontractor(s).

Any subcontractor with whom Pescadore shares data will be responsible for processing the personal data of users, on its behalf and for its account, committed to adopting the necessary technical and organizational measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, and against any other form of unlawful processing, and will be responsible for proper use and in accordance with legal terms.

Without prejudice to the provisions of the preceding paragraph, Pescadore remains responsible for the processing of personal data in accordance with legal terms and within the respective limitations of use.

8. Access to Third-Party Websites

This privacy policy does not apply to third-party websites or support media that the user may access through this website. In this case, whenever you visit another website from this one, you should always read the applicable privacy policy and verify that you agree with its terms before providing your personal data.

Pescadore is not responsible for the privacy policy or personal data processing applicable on third-party websites, nor for the content provided on those websites.
