2. Purchase and Sale Conditions
By placing an order on our website, the Customer accepts these Purchase and Sale Conditions, which govern the contractual relationship between the Customer and Homero Coutinho / Pescadore.
2.1. Products
The products available for sale are mainly clothing and personalized clothing.
Each product is presented with a detailed description of its essential characteristics, including materials, available sizes and colors, as well as customization options.
Product images are as accurate as possible; however, slight differences in color or detail may occur due to screen calibration or production processes.
2.2. Prices
Product prices are indicated in Euros (€) and include the Value Added Tax (VAT) at the legal rate in force in Portugal.
Prices do not include shipping costs, which will be calculated separately and added to the total order value at checkout.
We reserve the right to change prices at any time, but the price invoiced to the Customer will always be the price displayed at the time of order confirmation.
The rules regarding discounts and promotions follow the Portuguese legislation in force, namely Decree-Law no. 10/2015, of January 16 (Legal Regime for Discounts and Promotions), with subsequent amendments.
2.3. Orders
To place an order, the Customer must add the desired products to the shopping cart and follow all steps of the purchase process, filling in the requested information.
Order confirmation implies full and unreserved acceptance of these Purchase and Sale Conditions.
After placing the order, the Customer will receive a confirmation email with the order details.
2.4. Payment Methods
We accept the following payment methods for your convenience and security:
Debit and Credit Cards: Visa, Mastercard, American Express, and other common credit/debit cards.
Mobile Payment: Google Pay and Apple Pay.
Multibanco: Payments via Multibanco reference (available for Portugal only).
Bank Transfer: Bank transfer details will be provided at the end of your purchase. The order will be processed after confirmation of payment receipt.
2.5. Shipping
We ship to all countries within the European Union.
Orders are processed and shipped within 2 to 3 business days after payment confirmation.
Delivery times may vary depending on the destination and the selected shipping service. Shipping costs will be calculated at checkout.
2.6. Returns and Exchanges (Right of Withdrawal)
Under European and Portuguese law (Decree-Law no. 24/2014, of February 14, amended by Law no. 47/2014, of July 28), the Customer has the right to withdraw from the contract without giving any reason, within 14 days from the date of receipt of the products. However, at Pescadore, we extend this period to 15 calendar days for your greater convenience.
How the return process works:
Return Request: The Customer must request the return within a maximum of 15 calendar days from the date of receipt of the order. The request can be made via email to orders@pescadore.com or through your reserved client area on our website, using the link provided in the order confirmation. Please indicate your order number and the items you wish to return.
Authorization and Shipping Address: After your request, you will receive an email with return authorization and the address to which you should send the items.
Item Shipment: The Customer must send the returned item(s) to the indicated address. It is the Customer’s responsibility to ensure that the item arrives in perfect condition. We recommend using a traceable shipping method.
Item Verification: Upon receipt of the returned item(s), our team will verify that they are in perfect condition, with no signs of use, washing, or damage, and with all original tags. Items that do not meet these conditions may not be accepted for return.
Refund Deadlines:
Once the condition of the returned item(s) has been verified and approved, the refund will be processed within a maximum of 14 business days from the date of receipt of the return.
The refund will be issued using the same payment method used for the purchase. If the original payment was made via Multibanco reference, the Customer must provide their IBAN for the refund to be processed by bank transfer.
Who bears the cost of return shipping:
The cost of return shipping is borne by the Customer, except in cases of manufacturing defect or non-conformity of the item.
2.7. Exceptions to the Right of Withdrawal (Personalized Goods)
According to Portuguese legislation (Decree-Law no. 24/2014, of February 14), the right of withdrawal does not apply to goods manufactured according to consumer specifications or clearly personalized.
This means that, for personalized items (with engravings, special measurements, exclusive designs, etc.), we do not accept returns or exchanges, except in case of manufacturing defect or non-conformity.
2.8. Manufacturing Defects or Non-Conformity
If an item, including personalized ones, presents a manufacturing defect or does not conform to the agreed specifications, the Customer has the right to contact us immediately via orders@pescadore.com or +351 967 219 573.
We will analyze the case and offer appropriate solutions, which may include repair, item replacement, price reduction, or, ultimately, contract termination with a refund of the amount paid, at no additional cost to the Customer.
2.9. Discounts and Promotions
Homero Coutinho / Pescadore may carry out discount campaigns and other promotions, which will be duly publicized on the website and/or other communication channels.
All promotions and discounts are governed by applicable Portuguese legislation, namely Decree-Law no. 10/2015, of January 16, and are subject to specific terms and conditions (validity periods, applicable items, minimum purchase requirements, etc.), which will be clearly indicated at the time of their disclosure.
Unless expressly stated otherwise, discounts and promotions cannot be combined with each other or with other promotional codes.
3. Warranties
All products sold by Homero Coutinho / Pescadore benefit from the legal conformity warranty provided for in Decree-Law no. 84/2021, of October 18, which transposes Directives (EU) 2019/771 and (EU) 2019/770.
3.1. Warranty Period
For new movable goods (including clothing), the legal warranty period is 3 (three) years from the date of delivery of the goods to the consumer.
3.2. Lack of Conformity
A lack of conformity is considered to exist when the good does not meet the subjective and objective conformity requirements, namely if:
It is not fit for the purpose for which goods of the same type are normally used.
It does not correspond to the description, type, quantity, and quality and does not possess the functionality, compatibility, interoperability, and other characteristics provided for in the purchase and sale contract.
It does not possess the qualities and characteristics customary in goods of the same type and which the consumer can reasonably expect, taking into account the nature of the good and any public statements made by the seller, producer, or their representative.
3.3. Consumer Rights
In case of lack of conformity of the good, the consumer has the right, successively and under the legally established conditions, to:
Repair of the good.
Replacement of the good.
Proportional price reduction.
Contract termination (refund of the amount paid).
The repair or replacement of the good must be carried out free of charge, within a reasonable period (maximum of 30 days for movable goods), and without serious inconvenience to the consumer.
3.4. Burden of Proof
During the first year after the delivery of the good, it is presumed that the lack of conformity already existed at the time of delivery.
After the first year and until the end of the third year, it is up to the consumer to prove that the lack of conformity existed at the time of delivery of the good.
3.5. How to Activate the Warranty
To activate the warranty, the Customer must report the lack of conformity to Homero Coutinho / Pescadore within 2 (two) months from the date they detected the defect, using the contacts indicated in section 1 (Company Information). Proof of purchase (invoice or receipt) is indispensable.
3.6. Warranty Exclusions
The legal warranty does not cover defects or malfunctions resulting from:
Improper or negligent use of the product.
Normal wear and tear of the item.
Improper maintenance or cleaning (failure to follow washing/care instructions on the product label).
Alterations or repairs carried out by unauthorized third parties.
4. Conflict Resolution and Legal Forum
Homero Coutinho / Pescadore guides its conduct by ethics and good faith. However, in the event of any dispute, we will always seek the fairest and most amicable solution.
4.1. Submitting Complaints
Direct Contact: Any complaint or dissatisfaction can be submitted directly to Homero Coutinho / Pescadore via email at geral@pescadore.com or by phone at +351 967 219 573. We will make every effort to respond and resolve the issue as quickly as possible.
Electronic Complaints Book: The Customer may also resort to the Electronic Complaints Book, available at www.livroreclamacoes.pt.
4.2. Alternative Consumer Dispute Resolution (ADR)
In the event of a dispute, and under article 18 of Law no. 144/2015, of September 8 (Law on Alternative Consumer Dispute Resolution), the consumer may resort to Alternative Consumer Dispute Resolution Entities (ADR). The updated list of ADR entities can be consulted on the Consumer Portal, at www.consumidor.pt.
We inform you that Homero Coutinho / Pescadore is not bound to any specific alternative consumer dispute resolution entity.
4.3. European Online Dispute Resolution Platform (ODR)
For cross-border disputes arising from online contracts, consumers can use the European Online Dispute Resolution (ODR) Platform, available at http://ec.europa.eu/consumers/odr/.
4.4. Applicable Law and Jurisdiction
These Purchase and Sale Conditions and any contracts concluded through the website are governed by Portuguese law.
For the resolution of any dispute arising from the interpretation or execution of these Purchase and Sale Conditions, or any purchase and sale contract concluded between the parties, the courts of Leiria, Portugal, shall have jurisdiction, with express waiver of any other.
4.5. International Customers (European Union)
Given that shipments are only made to countries within the European Union, consumer rights, including those relating to returns and warranties, will be largely harmonized by European directives transposed into the legislation of each Member State. However, Portuguese law shall always prevail as the forum for dispute resolution.
5. Intellectual Property
All content present on this website, including, but not limited to, texts, graphics, images, photographs, logos, icons, videos, designs, interfaces, software, and all other elements that compose it, are the exclusive property of Homero Coutinho / Pescadore or third parties who have granted the respective license for use.
This content is protected by national and international laws on copyright, industrial property, and other intellectual property protection laws.
The use, reproduction, modification, distribution, transmission, republication, display, or performance of any content present on the website for commercial or public purposes, without the prior written authorization of Homero Coutinho / Pescadore, is strictly prohibited.
Access to the website does not grant the user any right over the content made available.
6. Limitation of Liability
Homero Coutinho / Pescadore strives to ensure that the information presented on the website is accurate and up-to-date. However, we cannot guarantee the absence of errors or omissions, nor its complete accuracy or timeliness at all times.
Website Availability and Functioning: We do not guarantee the uninterrupted or error-free operation of the website. Homero Coutinho / Pescadore will not be liable for any direct or indirect damages resulting from the use or inability to use the website, including, but not limited to, service interruptions, computer viruses, system or line failures.
Product Use: Homero Coutinho / Pescadore is not responsible for any damage or accidents resulting from improper or negligent use, or use not in accordance with the care and washing instructions of the purchased products. It is the Customer’s responsibility to read and follow the care and safety instructions for each product.
Third-Party Information: The website may contain links to third-party websites. Homero Coutinho / Pescadore has no control over the content of these websites and, as such, is not responsible for their accuracy, reliability, or the privacy or cookie policies they may practice.
Indirect Damages: Homero Coutinho / Pescadore will not be liable for any indirect losses or damages, such as lost profits, loss of data, loss of opportunities, or any other indirect damages that may arise from the use of the website or the purchase of products.
7. Changes to the Terms and Conditions
Homero Coutinho / Pescadore reserves the right to review and amend these Purchase and Sale Conditions at any time, without prior notice.
Any changes will be published on this page and will take effect immediately upon their publication.
Continued use of the website after the publication of changes constitutes tacit acceptance of them.
We recommend that the Customer consult this page regularly to stay updated on the conditions in force.
8. Final Provisions
Validity of Clauses: If any provision of these Purchase and Sale Conditions is deemed invalid, illegal, or unenforceable by a competent authority, such provision will be removed or limited to the minimum extent necessary, without affecting the validity and enforceability of the remaining provisions.
Communication: All relevant communications between Homero Coutinho / Pescadore and the Customer, under these conditions, will preferably be made by email or through the client area of the website.
Entire Agreement: These Purchase and Sale Conditions constitute the entire agreement between Homero Coutinho / Pescadore and the Customer regarding the purchase and sale of products through this website, replacing any prior agreements or understandings, whether written or verbal.
